I just returned from my 4 days cruise with a stop at Calica, Mexico. Here is my experience with the Customs and Border Patrol officer at the Port of Miami:
I told him that we had applied for green card and handed him the original AP approval notices. He went through our passports to look at our visa stamps. He pointed out that the Visa stamps in our passports had expired, he asked me if I still work with the same company, I answered "Yes" and handed him our new H1 extension approval notices. He looked at the documents (guess looked at name and validity dates) and then took all the documents to another officer.
After returning to his desk he justed entered some data into their system (I think our passport numbers) and told us we were good to go. He did not take our AP notices and did not issue new I-94.
(while embarkation the Carnival staff had looked at our AP notices and hence had not asked for our old I-94s).
I wish all of us a very happy new year.

That is not a flaw in the system and in the USCIS manual, they know it. Since the previous I-140 is already approved and you've stayed more than 6 months in that I-140, then there's no need for the ability to pay. USCIS is treating your case as if you already have a GC, it is just that it is pending.
If one has a GC, he can transfer to another employer. It is your risk if your new employer has not the ability to pay you. The same is true with portability, USCIS doesn't care anymore if you transfer to an employer with no ability to pay you because the first I-140 is already approved and you worked for it already. They are concerned now about your I-485 (AOS) and your qualifications under it.
If one has a GC, he can transfer to another employer. It is your risk if your new employer has not the ability to pay you. The same is true with portability, USCIS doesn't care anymore if you transfer to an employer with no ability to pay you because the first I-140 is already approved and you worked for it already. They are concerned now about your I-485 (AOS) and your qualifications under it.

Great work IV core team! EB immigration will be benefited by the work done by IV core team sooner or later. Keep it up!!
One will wonder that Indian Government will do something as the India and her economy are benefited by EB immigration big time in last decade. In the global economy the overseas workers are the greatest strength India has and as usual they are completely ignoring the problems faced by EB immigrants in the USA.
Just a thought,
Involving India or any other foreign Government is not a good idea. It can result to severe backlash.
One will wonder that Indian Government will do something as the India and her economy are benefited by EB immigration big time in last decade. Thank for the reply. I hope the suggestions will be acted on and implemented at the earliest. It's frustrating to see that the priority dates haven't moved by a single day in last 6 months, something really needs to be done and I will do my support IV with anything.

There are few brave souls who refuse to give up and are fighting for the greater benefit of the entire community!

You will need to take multiple appointments to actually get the answers you are looking for. It all depends on how friendly the person is.
I have had at least one appointment where the lady was so kind that she actually told me the date/time my files were touched by the processing officer at the NSC. Infopass officers have a lot of information on their screens.
Dress decently.
It helps to have a friendlier inquisitive tone rather than desperation.
Remember these USCIS employees (infopass) see 100s of people in a week. There is no requirement for the person to provide you more information that they actually want to share.
Some days are busy for them with lots of appointments.
Some days there are just few people - when you have better chances of getting friendlier information.

Heh. Sure I updated both at USPS AND at USCIS -- and yes I had my Alien # and the receipt number (I got married after I applied for 485 -- so waiting for dates to become current again EB2-May06 to add her).
Question: did you update your new home mailing address online at USPS (Postal website) or using USCIS (Change address) at the time of updating your new mailing address? Initially you do receive a confirmation # when you fillout first part of online application then later you would see additional links at the bottom of page where it would ask for "are there any pending application" somthing like that...

That is true. This thing called "special handling" in common parlance is, thank god, not a hot topic of discussion. I hope this clause doesn't get weeded out given the current scenario where they have killed F4. I really wonder if "highly skilled" legal immigrants would ultimately get any benefit out of this bill. Limboland is where many people are - and at the end of the day you still get to live in Limboland and become its citizens by default.

If this amendment passes, all that would be gone, and simply replaced with the exemption that was already in the original bill. Again I'm puzzled: why are we supporting this amendment?

Here are the steps in setting up "Bill Pay" from your Bank account (online)
1) Check with your bank if "Bill Pay" is a free service, or not for your account. Some banks have conditions that must be met for e.g. Direct Deposit, Certain minimum balance, certain type of account or not. If you don't meet the criteria your bank may charge a service fees for using "Bill Pay"!
2) You might need to get "Bill Pay" activated on your online account. This might be possible for some by clicking on a "Service Agreement" screen. For others you might need to visit the Bank to get it activated.
3) Most banks that support "Repeating payments" allow you to "Add Payee" for future transactions. Provide IV address here and add "Immigration Voice" as a payee

4) Click on link that says "Setup Repeating Payments" in the "Bill Pay" section (some might provide this option while setting up payments and not provide a separate section)
Select "Immigration Voice" as the payee. Enter the amount you would like to send to IV every month. Select the frequency as "Monthly" ( there may be other options such as daily, bimonthly, annually, quarterly etc. choose the one suitable for you.)
In the "message to payee" (or something similar) provide your E-mail id. This will be used by IV to inform you of check enchashment (thank you note). Will help you track the payment end-to-end.
6) Bank account (Bill pay section) will give you a list of all checks sent to IV (from the Bank). If any check hasn't been acknowledged, call IV and make sure it's been received!

1) Check with your bank if "Bill Pay" is a free service, or not for your account. Some banks have conditions that must be met for e.g. Direct Deposit, Certain minimum balance, certain type of account or not. If you don't meet the criteria your bank may charge a service fees for using "Bill Pay"!
2) You might need to get "Bill Pay" activated on your online account. This might be possible for some by clicking on a "Service Agreement" screen. For others you might need to visit the Bank to get it activated.
3) Most banks that support "Repeating payments" allow you to "Add Payee" for future transactions. Provide IV address here and add "Immigration Voice" as a payee

4) Click on link that says "Setup Repeating Payments" in the "Bill Pay" section (some might provide this option while setting up payments and not provide a separate section)
Select "Immigration Voice" as the payee. Enter the amount you would like to send to IV every month. Select the frequency as "Monthly" ( there may be other options such as daily, bimonthly, annually, quarterly etc. choose the one suitable for you.)
In the "message to payee" (or something similar) provide your E-mail id. This will be used by IV to inform you of check enchashment (thank you note). Will help you track the payment end-to-end.
6) Bank account (Bill pay section) will give you a list of all checks sent to IV (from the Bank). If any check hasn't been acknowledged, call IV and make sure it's been received!

I would suggest that you follow the option of joining some other company, if that is possible. You would be joining with enough experience so as to qualify for a new EB2 application. You can retain your EB3 application and priority date if 180 days have passed since filing 485, which in your case has happened so you are OK.
Trying to file an EB2 application through the same employer might be tricky because you cannot count the experience that you have gained with the employer. Even though a case could be made that you have a masters degree in business but I suspect that that may not be enough as, if I understand you correctly, you have no "business development" experience from your previous employment. Thus you would be a candidate with a degree but no experience.
Just my two cents.

I have a H1B visa valid till Apr 2009(still i can extend 3 more years). I am going to file I-140 and I-485 together on EB2 category. Along with this I am going to apply EAD for me and my wife.
What will be the status of my H1B if my EAD got approved and I-140 is still pending. In case if my I-140 get rejects, will i be out of status or I can continue with same H1B if i don't change company?
Or better to apply EAD for me (not to my wife) after the I-140 approval?
Please help me..

Applying for EAD doesnt change your status from H1B to AOS. Using the EAD to get a job will change your status.
If you continue working on H1B , even if your I140 gets rejected you're still on h1B.
If I am not wrong your EAD/AP will not be processed until after your I140 is approved.Maybe some one comment on this

Hi everyone,
I am trying to reschedule my H1B appointment as my contact in mumbai failed to deliver the DS-156 and DS-157 to the consulate in time (5 business days prior). However, I can't book a new one till the old one is cancelled and the system won't let me cancel 5 business days or less before the current appointment. Does anyone know what to do? It must have happened to someone before? I really need to get back to the US in 10 days.

It happened to my parents. They did not know that they had to drop the packet 5 days before the schedule date. While reading on the website, I found out that they need to drop the packet 5 days before. They then dropped the packet at the embassy 3 days before appointment day. On the appointment day, the visa officer rejected the application after asking one question "why you want to go to the USA?". The reason was a standard line -- not enough evidence that you will come back.
I am not sure about the reason of rejection but I think it has to do with not dropping the packet on time.
